Planning and conduct of public procurement

The phases of the procedures for awarding public contracts are codified in article 32 of Legislative Decree no. 50/2016 smi and represent one of the focal points of the activity of the public administration. Behind the drafting of a tender notice there is an important preparatory activity of the contracting authority whose purpose is to identify the essential elements of the contract and according to this, to choose the criterion for evaluating both the economic operators and the offers received. Among the main activities of preparation of the tender are those concerning the planning of the same and its conduct, ie: • Preparation of the tender documentation: determining, disciplinary, General specifications, Special specifications • Calling and publication of the tender • Presentation of offers and selection of economic operators • Assistance in the process of training the technical evaluation commissions • Evaluation of offers • Management and supervision of the tender process (critical analysis, preparation and drafting of requests for clarifications) • Preparation of clarifications on the tender clauses • Preparation of the tender procedure verification of the anomaly of the offer • Awarding of the contract • Controls pursuant to art.80 (to be checked) • Assistance in the stipulation of contracts • Preparation and drafting of Public Procurement Observatory Sheets • Preparation of ANAC communications • Management of digital order archive

RUP support in the preliminary, executive, conclusive phases and in disputes

Legislative Decree 50 of 2016, subsequent amendments, consolidated the central position in the public administration of the Single Head of the Procedure (RUP) who is now responsible for multidisciplinary functions. To support the figure of the RUP, the same Legislative Decree in article 31 provides that "the contracting authority, in order to improve the quality of the overall planning and planning, may, within its organizational autonomy and in compliance with limits set by current legislation, to establish a stable structure to support the RUPs, also reporting directly to the top of the public administration of reference.
